Terms of service

1. The agreement

These terms govern your use of Kelso apps, including Kelso: Back in Stock Alerts, and of kelsohq.com. Installing an app or using the site means you accept them. If you are installing on behalf of a business, you accept them for that business.

2. The service

Kelso: Back in Stock Alerts lets your customers subscribe to restock notifications and sends those notifications when inventory returns. We provide the service as described on this site and in the Shopify App Store listing. We may improve or change features over time; we will not remove core functionality from a paid plan you are on without notice.

3. Billing

  • Fees are charged through Shopify's billing system on the plan you select, monthly or annual.
  • Plans are flat. There is no revenue share and there are no overage charges. Over your send limit, sends hold until you upgrade or your billing month resets.
  • You can change plans or cancel at any time by changing your plan in the app or uninstalling. Shopify's billing rules govern proration and refunds; beyond those, annual plans are refundable pro rata within the first 30 days.

4. Your responsibilities

  • Use the app only to send restock notifications that your customers requested. No purchased lists, no unrelated marketing blasts through our sending infrastructure.
  • Comply with the laws that apply to your store, including consumer protection and email consent laws in the regions you sell to.
  • Keep your Shopify account secure. Actions taken through your account are yours.

We may suspend sending for accounts that damage deliverability for other merchants, and will contact you before or promptly after doing so.

5. Your data

Your store's data and your customers' subscriber data remain yours. Our handling of that data is described in the privacy policy, which is part of these terms.

6. Service quality

We build for reliability: redundant restock detection, paced sending, and a full audit log. Still, the service depends on third parties, including Shopify's APIs and email infrastructure, and is provided "as is" without warranty of uninterrupted operation. We commit to the support response times published on our support page.

7. Liability

To the extent permitted by law, our total liability for any claim arising from the service is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect damages, including lost profits or lost sales.

8. Termination

You can stop using the service at any time by uninstalling. We may terminate accounts that violate these terms. On termination, data is handled as described in the privacy policy.
